Governor Whitmer Signs Executive Directive Strengthening Enforcement of COVID-19 Orders
Suspension of a Michigan License a Possible Consequence for Violations of Relevant COVID-19 Executive Orders

The MAC has been sending members regular updates on all the Governor’s Executive Orders and Directives and we will continue to do so. As you are probably very aware, the MAC is not a state regulatory body. We are a professional association advocating for the rights of chiropractors and their patients across the state of Michigan. We are working daily to help protect your right to practice. It is our responsibility to let you know there are potential ramifications to your license if you violate formal COVID-19 Orders and Directives.

Unfortunately, during this time, health care providers may face complaints from the public or other businesses or entities. To date, the MAC has been able to resolve many of these complaints when we receive them. However, the state has identified several ways for people or entities to make formal complaints directly to the state and the MAC may not be able to intervene. Please be sure you are following directives such as limitations on capacity and the requirement to wear masks when at all possible.

Most importantly for health care providers, Executive Directive 2020-08 is requiring state departments to consider violations of law when determining eligibility for licensing. This includes any violation of relevant COVID-19 executive orders or pandemic-related directives. If a state department or agency becomes aware of non-compliance under the law they must consider it to be presumptive evidence of a “public health hazard” or “imminent and substantial hazard to the public health” and take appropriate steps to mitigate any risk to public health and safety. This includes, but is not limited to, suspension of a license.

The MAC Legal Affairs team will continue to monitor this situation and will update the profession if events warrant. In the meantime, we recommend following all applicable State of Michigan and local orders during the COVID-19 pandemic state of emergency/disaster. This information is available on the MAC website.
