CRITICAL UPDATES
Michigan Legislature Votes to Extend State of Emergency Through April 30th
Be Advised: The State of Emergency Declaration and “Stay Home, Stay Safe” Executive Order NOT the Same Thing
Today, the Michigan Legislature voted to extend Michigan's state of emergency declaration 23 days, through April 30, 2020.
Be advised: The State of Emergency Declaration and Governor Whitmer’s “Stay Home, Stay Safe” Executive Order are NOT the same thing. That order, Executive Order 2020-21, continues to run through April 13, 2020, at 11:59pm.
The action by the Legislature today was necessary because Michigan’s Constitution limits the Governor’s ability to declare an emergency declaration to 28 days. With no action from lawmakers, the original State of Emergency would have expired today. The Declaration of State of Emergency can also be extended again by the legislature, if necessary.
With the extension, Governor Whitmer has the power to extend, revise, or revoke her previous executive orders, as well as issue new ones. Governor Whitmer is currently said to be reviewing E.O. 2020-21 and is likely to extend it prior to its expiration on April 13th. Stay tuned for more information as it becomes available.
