2.  CARES Act Provider Relief Fund: Clarification of Intent from HHS
“Care Does Not Have to Be Specific to Treating COVID-19. HHS Broadly Views Every Patient as a Possible Case Of COVID-19.”

Yesterday (April 13), the U.S. Department of Health and Human Services updated their web page regarding the Coronavirus Aid, Relief, and Economic Security (CARES) Act Provider Relief Fund. The fund, passed last month, is designed to “provide relief to both providers in areas heavily impacted by the COVID-19 pandemic and those providers who are struggling to keep their doors open due to healthy patients delaying care and cancelled elective services.” Payments are based on the provider’s share of total Medicare FFS reimbursements in 2019 (see below).

After the funds began appearing in providers’ accounts last Friday, the MAC received some calls regarding the Terms and Conditions associated with accepting them, particularly the section that reads:

The Recipient certifies that it billed Medicare in 2019; provides or provided after January 31, 2020 diagnoses, testing, or care for individuals with possible or actual cases of COVID-19…

These Terms and Conditions must be accepted within 30 days of receipt of payment. Not returning the payment within 30 days of receipt will be viewed as acceptance of the Terms and Conditions. If a provider receives payment and does not wish to comply with the Terms and Conditions, they must contact HHS within 30 days of receipt of payment and then remit the full payment to HHS as instructed. Appropriate contact information will be provided soon, on the main CARES Act Provider Relief Fund page.

On Monday, HHS updated the web page, which now states:

“Care Does Not Have to Be Specific to Treating COVID-19. HHS Broadly Views Every Patient as a Possible Case Of COVID-19.”

Other Terms and Conditions require those accepting funds to certify they will not use the payment to reimburse expenses or losses that have been reimbursed from other sources (such as the PPP loan or EIDL), as well as to submit reports to ensure compliance.
The MAC cannot decide for you if you should accept these funds. We do, however, highly recommend that every chiropractor who billed Medicare in 2019 and is therefore due a payment from the CARES Act Provider Relief Fund carefully review both the Terms and Conditions and the CARES Act Provider Relief Fund web page. If you do not feel that you in good conscience can live up to these Terms, you must return the funds received.

More on the CARES Act Provider Relief Fund:

  • The funds began being automatically deposited (with “HHSPAYMENT” as the payment description) into bank accounts last Friday. For providers who are typically paid by check from Medicare, payments should arrive in the next two weeks.

  • To determine your portion of the fund, take your Medicare reimbursable billings and divide them by the total Medicare billings in 2019, $484 billion, and then multiply by $30 billion (the amount in the fund). For example, a doctor who billed $50,000 in 2019 would receive around $3,100 (50,000 / 484,000,000,000 X 30,000,000,000 = 3,099).

 
 
Spring 2020 Convention Turned Virtual
After careful consideration, monitoring of events, and weighing all our options, and in conjunction with the latest guidelines established by the Centers for Disease Control and Prevention (CDC) at the direction of President Trump, with heavy heart the MAC is cancelling our in-person convention.

In place of the in-person event we cordially invite you to participate in our "Virtual Convention" with a series of webinars from amazing speakers like Dr. Heidi Haavik, Dr. Francis Murphy, Dr. Evan Gwilliam, and more. Our virtual convention will begin on convention weekend, April 25th.  More details to come soon!

If you have already signed up for the Spring Convention, we have several options:

  • Option 1: Remain registered and take part in Spring 2020 as a virtual event (to include the 2 hours in physical measures and 2 hours in performance and ordering of tests)
  • Option 2: Apply your payment to our Fall Convention (September 25-27 at the Renaissance Center in Detroit) or our Express Convention (November 21-22 at the Soaring Eagle Casino and Resort in Mt. Pleasant)
  • Option 3: Request a full refund
